Motion for Summary Judgment, or in the Alternative, Summary Adjudication

Having considered the moving, opposing, and reply papers, the Court rules as follows.

BACKGROUND

On June 4, 2019, Plaintiff Deborah Miller (“Plaintiff”) filed a complaint against Defendants PIH Health Hospital – Downey, PIH Health, and Humanscale Corporation (erroneously sued and served as Humanscale). Plaintiff alleges negligence and strict products liability in the complaint for a chair that fell apart and caused Plaintiff to fall on September 15, 2017.

On July 19, 2019, Defendant/Cross-Complainant Humanscale Corporation filed a cross-complaint against Defendant/Cross-Defendant PIH Health Hospital – Downey and Cross-Defendants PIH Health Downey Medical Group, Inc. and PIH Health, Inc. seeking equitable indemnity, apportionment, and declaratory relief.

On September 10, 2019, the Court dismissed Plaintiff’s complaint as to Defendant/Cross-Defendant PIH Health Hospital – Downey (erroneously sued as PIH Health)
