Motion for Leave to Intervene
Having considered the moving papers, the Court rules as follows. No opposing papers were filed.
BACKGROUND
On May 20, 2019, Plaintiff Elias Kharazi (“Plaintiff”) filed a complaint against Defendant Alliance Textiles, Inc. (“Defendant”) alleging negligence and premises liability for a pedestrian-forklift collision that occurred on June 14, 2018.
On August 21, 2019, Plaintiff-in-Intervention Insurance Company of the West filed a motion for leave to file a complaint-in-intervention pursuant to California Code of Civil Procedure section 387.
Trial is set for November 30, 2020.
PARTY’S REQUEST
Plaintiff-in-Intervention Insurance Company of the West (“Intervening Party”) seeks leave to file a complaint in this action because Intervening Party has paid and continues to pay workers’ compensation benefits to Plaintiff as a result of the subject accident.
LEGAL STANDARD
