[TENTATIVE] RULING:
Defendant U Turn Seven Corporation, Inc. improperly filed a single motion to compel responses to three individual discovery devices. The omnibus motion should have been filed as three separate motions. Defendant is ordered to pay two additional motion fees prior to the hearing.
Plaintiff served verified responses to the subject discovery. Consequently, the motion is MOOT.
Given the straightforward nature of the subject motion and the length of the reply, the court will award Defendant U Turn Seven Corporation, Inc. monetary sanctions to compensate it for its attorney’s time at an hourly rate of $350 and to reflect 2 hours to draft the subject motion, 1 hour in connection with the opposition and reply, and 1 hour for the hearing, as well as $180 for the cost of three filing fees. The court, therefore, GRANTS defendant U Turn Seven Corporation, Inc. monetary sanctions of $1,580 against Plaintiff. These sanctions are to be paid within 30 days of the court’s ruling.
