Plaintiff Cesar Mendez’s motion is GRANTED in the reduced total amount of $41,315.33.

On April 10, 2020, Plaintiff Cesar Mendez commenced this Lemon Law action against Defendant Mecedes-Benz USA LLC, Car Well LLC, and Europa Auto Imports Inc. The Complaint states three causes of action for Song Beverly Consumer Warranty Act violations, and negligent repair. Plaintiff dismissed Car Well on October 30, 2019. On August 20, 2020, the parties represented that the case was settled.

On October 2, 2020, Plaintiff filed the instant motion for attorneys’ fees pursuant to the parties’ settlement agreement and Civil Code § 1794(d). On October 21, 2020, Defendants filed an opposition. On October 27, 2020, Plaintiff filed a reply.
