DEFENDANTS’ Demurrer TO THE complaint
On April 8, 2019, plaintiff Ningbo Zhuoyou Shoes Co., Ltd (“Plaintiff”) filed this action against defendants Inter-Pacific Trading Corporation and Does 1 through 50 alleging causes of action for breach of contract and common counts.
On June 28, 2019, Defendant Inter-Pacific Trading Corporation (“Defendant”) filed a demurrer to the Complaint. Defendant’s Demurrer to the Complaint is TAKEN OFF CALENDAR AS MOOT. (CCP § 128.) Plaintiff is entitled to amend at least once without leave of court before the answer or demurrer is filed; or if Defendants demur, before the opposition is due on the hearing on the demurrer. (CCP § 472(a).) Plaintiff filed a First Amended Complaint on July 8, 2019 -- before the due date for Plaintiff’s opposition to Defendant’s demurrer.
