DISCUSSION:

This case arises from the Plaintiffs’ claim that the Defendants are improperly foreclosing on their property because they recorded a default on the property with contacting them and while their application for a loan modification was pending.

The Plaintiff appeared with an ex parte application on August 3, 2017 and requested a temporary restraining order and an OSC regarding a preliminary injunction to enjoin the Defendants from selling his real property. The Plaintiff claims that there is good cause for a preliminary injunction under Civil Code section 2923.6.
