Motion for Leave to Amend Complaint

Having considered the moving papers, the Court rules as follows. No opposing papers were filed.

BACKGROUND

On March 21, 2019, Plaintiff Claudia Venegas (“Plaintiff”) filed a complaint against Defendant San Pedro Fish and Oyster Corporation dba Crusty Crab (“Defendant”). The complaint alleges negligence for a fall from a defective table and bench that occurred on April 2, 2017.

On March 25, 2019, Plaintiff filed a first amended complaint to allege premises liability.

On December 12, 2019, Plaintiff filed a motion for leave to file an amended complaint pursuant to California Code of Civil Procedure section 473, subdivision (a)(1).

Trial is set for September 17, 2020.
