Motion for Leave to Amend Complaint; Motion for Trial Preference
Having considered the moving and opposing papers, the Court rules as follows. No reply papers were filed.
BACKGROUND
On March 19, 2019, Plaintiff Rachel Moncada (“Plaintiff”) filed a complaint against Defendants Angels Trans, Inc. and Kerob Simonyan (“Defendants”). The complaint alleges motor vehicle negligence for an automobile-pedestrian collision that occurred on January 18, 2019.
On June 19, 2019, Defendants/Cross-Complaints Angels Trans, Inc. and Kerob Simonyan filed a cross-complaint against Roes 1 through 20 seeking indemnity, contribution, and declaratory relief.
On May 26, 2020, Plaintiff filed a motion for leave to file a first amended complaint (“FAC”) pursuant to California Code of Civil Procedure section 473, subdivision (a)(1).
On May 27, 2020, Plaintiff filed a motion for trial preference pursuant to California Code of Civil Procedure section 36.
A trial setting conference is scheduled for October 1,
