[TENTATIVE] ORDER RE: PETITION TO APPROVE COMPROMISE OF DISPUTED CLAIM

Claimant Gerald Penny (“Claimant”), a disabled adult, by and through his adult son and Guardian Ad Litem, John Penny (“Petitioner”), has agreed to settle his claims against Defendant Chiau Chi Kung in exchange for $1,600,000.00. If approved, $25,175.87 will be used for medical expenses, $533,333.00 will be used for attorney’s fees, and $21,344.56 will be used for non-medical expenses, leaving a balance of $1,020,146.24 for Claimant. The petition alleges Claimant lacks the capacity to manage the settlement proceeds. Therefore, the petition requests the proceeds be distributed to Petitioner, as trustee of the Gerald Penny Living Trust Dated September 26, 2019 (“Trust”). Alternatively, Petitioner requests the Court make the net settlement proceeds payable to Petitioner in his capacity as agent under a general durable power of attorney to fund the Trust.

Court approval is required for all settlements of claims by a pe
