Plaintiff, formerly employed as a driver aid starting in August 2007 for Defendants, brings this complaint to allege that she was sexually harassed by her supervisor starting in 2017 and was terminated on December 19, 2018 in retaliation for her complaints of sexual harassment and hostile work environment. (Complaint, ¶¶7-15.)
On March 11, 2019, Plaintiff Gabriela Najera commenced this action against Diversified Transportation, LLC and Bryan Otchis for (1) retaliation in violation of California Government Code § 12940(h); (2) workplace harassment in violation of California Government Code § 12940(j); (3) failure to prevent harassment in violation of California Government Code § 12940(j) and (k); and (4) wrongful termination in violation of public policy.
