[TENATIVE] ORDER RE MOTIONS TO COMPEL DISCOVERY RESPONSES

On January 28, 2019, Plaintiff Mindy Pfeiffer (“Plaintiff”) filed this action against Defendant Kavis Healthcare, Inc. (“Defendant”) for elder abuse and fraud. On March 19, 2020, Defendant served Form Interrogatories, Special Interrogatories, and Request for Production of Documents on Plaintiff. Defendant granted a 30-day extension of the time for Plaintiff to respond. Plaintiff did not respond. Defense counsel called and wrote Plaintiff’s counsel about the missing responses. On June 25, 2020, Defendant filed motions to compel Plaintiff’s responses to discovery requests and monetary sanctions.

Plaintiff did not file an opposition, but on August 3, 2020, Plaintiff served verified responses. Therefore, the motions to compel are MOOT.

Sanctions shall be imposed against the party who fails to respond to discovery or unsuccessfully opposes a motion to compel, unless the party acted with substantial justification or the sanction wo
