Plaintiff Amber Rupp’s Motion to Compel Deposition of Defendant General Motors, LLC’s Person Most Knowledgeable is GRANTED.
MOTION TO COMPEL DEPOSITION
A party may make a motion compelling a witness’s deposition “after service of a deposition notice” if that witness “fails to appear for examination, or to proceed with it.” (Code Civ. Proc. § 2025.450, subd. (a).) The motion must include a meet-and-confer declaration and show good cause for the discovery sought. (Code Civ. Proc. § 2025.450, subd. (b)(1), (2).)
Plaintiff served a notice of deposition for GM’s person most knowledgeable on March 7, 2019. (Sarbaz Decl. ¶ 4.) GM served objections on March 27, 2019. (Sarbaz Decl. ¶ 5.) The parties thereafter met and conferred regarding GM’s objections. (Sarbaz Decl. Exh. C.) On June 29, 2020, Plaintiff proposed more dates for the deposition, and followed up on July 31 and August 3. (Sarbaz Decl. ¶¶ 7–9.
