Two (2) Motions by Defendant, Elzayat Dental Corporation, for order Compelling Plaintiff’s Responses to Special Interrogatories and Request for Production of Documents; Request for Sanctions, filed on 8/9/19, are GRANTED.

Defendant confirms that Plaintiff provided verified responses on 8/26/19, after this motion was filed. Reply, 2:10-12. Accordingly, an order compelling responses is no longer necessary.

The court imposes total sanctions of $720.00 for both motions against Plaintiff, Guadalupe Cristell Saldivar, and her counsel, Jason Smith, for the failure to respond or submit to an authorized method of discovery, which is discovery abuse. Cal Code Civil Procedure §2023.010(d). Such sanctions are payable within thirty (30) days.

Imposition of sanctions are permitted in favor of a party who files a motion to compel discovery, even though no opposition to the motion was filed or the requested discovery was provided to the moving party after the motion was filed. Cal Rules of Court 3.
