1. For good cause appearing, Plaintiff Magued R. Fadly, M.D.’s Motion for Order for Service of Summons on Defendants Anthony Rice and Justine Lorraine Heist Rice by Publication is GRANTED. Based on the papers and supporting declaration submitted, the Court finds that Defendants Anthony Rice and Justine Lorraine Heist Rice cannot with reasonable diligence be served in any manner specified in Code of Civil Procedure sections 415.10 through 415.40. Accordingly, service by publication is granted.
The Court enters Plaintiff’s proposed order.
The Court notes that on 03/25/2019, Plaintiff filed a proof of service indicating that Defendant Justine Lorraine Heist Rice was served by personal service. Plaintiff now represents to the Court that Defendant was not served. Thus, the Court disregards the proof of service filed by Plaintiff on that date.
