Plaintiffs Citizens for Amended Proposition L, Vernon Price and J. Keith Stephens seek the following:

(1) the appointment of a receiver to take possession of all monies being paid by third party advertisers for the continued operation of certain billboards and to deposit of those funds in an interest-bearing account;

(2) injunctive relief to require Defendant City of Pomona and Real Party in Interest Regency Outdoor Advertising, Inc. (Regency) to deliver possession of all monies received from third-party advertisers and any books of account reflecting the same to the receiver; and

(3) injunctive relief to require the City and Regency to disclose any potential purchaser of Regency (or any of its assets) and funds from any such sale be delivered to the receiver to satisfy the alleged $7,000,000 debt owed by Regency to the City.[1]

The City and Regency separately oppose the motion. Plaintiffs did not file a reply.

Plaintiffs’ unopposed request for judicial notice (RJN) is granted.
