Background
On November 18, 2019, Plaintiff Chapter One Land Trust filed a complaint against Defendants Select Portfolio Servicing, Inc. (“SPS”), Quality Loan Service Corp., Deutsche Bank, and Does 1-50 alleging: (1) Civil Code section 2923.6 violations; (2) negligence; and (3) Business and Professions Code section 17200 violations. On April 13, 2020, Plaintiff filed an amended complaint (FAC) changing the plaintiff’s name to Delane Tarra, individually and as trustee of Chap One Land Trust. The FAC also added violations of Civil Code sections 2923.7 and 2924.17, and a breach of the implied covenant of good faith and fair dealing.
