TENTATIVE RULING

Defendants Edward Czuker and Elissa Czuker’s Demurrer to First Amended Complaint is SUSTAINED, with twenty (20) days leave to amend as to the third, fifth and sixth causes of action, and SUSTAINED, without leave to amend, as to the first, second, fourth and eleventh causes of action.

Defendants Edward Czuker and Elissa Czuker’s Motion to Strike Portions of Plaintiff’s First Amended Complaint is GRANTED, in part, and DENIED, as MOOT, in part. Defendants’ motion to strike the request for punitive damages and statutory damages is DENIED, as MOOT, and GRANTED as to the request for attorney’s fees.

Plaintiff may amend his or her complaint only as authorized by the court’s order and may not amend the complaint to add a new cause of action without having obtained permission to do so. (Harris v. Wachovia Mortgage, FSB (2010) 185 Cal.App.4th 1018, 1023.)
