PETITION FOR PROBATE OF WILL AND FOR LETTERS TESTAMENTARY
AND AUTHORIZATION TO ADMINISTER UNDER THE INDEPENDENT
ADMINISTRATION OF ESTATES ACT
TENTATIVE RULING: The original will and codicils are not in the Court file. (Prob. Code, § 8200.) Petitioner shall lodge the original will and codicils with the Court at the hearing or the matter will be continued to January 17, 2020, to allow for the filing of the documents. If the materials are filed and are self-proving, the petition will be granted and petitioner shall file the proposed letters.
If petitioner does not have the original will and codicils, he shall submit a petition for probate of a lost or destroyed will on or before January 17, 2020. (Id., § 8223.) If a petition for probate of a lost or destroyed will is filed, petitioner shall re-notice the matter.
