UPDATED TENTATIVE RULING
Hearing: Charles Klein’s Discovery Motions (x4)
This is a conservatorship matter with competing petitions seeking to establish a conservatorship of Barbara Klein: one filed by Julie Klein (“Julie”)1, and a competing petition filed by Charles Klein (“Charles”).
On August 3, 2020, Charles propounded four sets of discovery on Julie: 1) Form Interrogatories, Set One; 2) Request for Admissions, Set One; 3) Special Interrogatories, Set One; and 4) Request for Production of Documents, Set One (collectively the “Discovery”). (Balsamo Decl.2, ¶ 2.)
As of September 21, 2020, Charles had received no responses to the Discovery, and he filed four discovery motions against competing petitioner Julie, seeking to compel responses to the Requests for Production, Special Interrogatories and Form Interrogatories within 5 days, and to deem the Requests for Admission admitted, and for monetary sanctions.
