William Braaten (“Petitioner”), beneficiary of the Lester Family Trust, including the Howard W. Lester Survivor’s Trust and the Lester Disclaimer Trust (the “Trust”) filed a verified Petition for Removal Surcharge of Trustee for Breaches of Trust, Excessive Trustee Fees, Objections to Trust Accounts, and Request for Determination that Personal Property is Not a Trust Asset pursuant to Probate Code sections 17200, 16400 et seq., 15642 et seq. and 850, against Mark Braaten, individually and as Trustee of the Trust (“Trustee”), on December 12, 2019.
Trustee filed a verified Response and Objection on June 30, 2020.
Petitioner now brings a motion to enjoin Trustee from depleting trust assets until completion of trial. Trustee opposes the motion.
Petitioner’s motion requests that:
A. MARK BRAATEN, Trustee, be enjoined from making any withdrawals from the Trust bank accounts, except in the necessary and ordinary course of Trust administration.
