The Court has reviewed Respondent's Opposition to Request for Forfeiture of Firearm. Respondent Thomas is entitled to a hearing as to whether the firearm should be returned to him, with Petitioner Chico Police Department bearing the burden of proof on all issues. In light of Respondent Thomas's pending criminal matter in 19CF04180 (People v. Thomas), the Court will hear from the parties on how they wish to proceed.
