Background Facts Plaintiffs, Legend Thirteen 26 LLC and Gabriel T. Fleming, Jr. filed this action against Defendants, Defond Avisard Trust, Renaud Defond, Jean Avisard, Wilshire West Commercial Real Esatte, Frank Morineau, Lee & Associates Commercial Real Estate Services, Inc. – South Bay, Garen Ramyan, and Craig Porpoat for damages arising out of a commercial real estate transaction. Plaintiff Fleming was the buyer in the transaction and has subsequently assigned his rights to Plaintiff Legend 13. Plaintiff alleges Defendants made various representations concerning the property, including that the property would be free from restrictions that would impair the value of the property; these representations were false, and caused Plaintiffs harm. Specifically, Plaintiffs allege the City of Long Beach and/or the Port was imposing restrictions on the permitted uses of the property, and that a Port railway expansion project was proposed that included the subject property ........
