Background Facts

Plaintiff, California Hotel & Lodging Ass’n filed this action against Defendant, City of Long Beach for declaratory relief and injunctive relief. Plaintiff sought a declaration that Measure WW, which specified requirements concerning employers’ payment of hotel room cleaners in the City of Long Beach, was enacted in violation of the Cal-OSHA Act of 1973. Plaintiff filed its complaint on 1/28/19.

The City responded to the complaint by demurrer; concurrently, Unite Here Local 11 filed an unopposed motion for leave to intervene in the action. On 5/07/19, the Court granted the motion for leave to intervene. On 6/27/19, the Court overruled the City’s demurrer.

On 8/29/19, the Court signed the parties’ joint stipulation regarding summary judgment briefing schedule. Thereafter, each of the three parties to the action (Plaintiff, Defendant, and Intervener) filed motions for summary judgment. The motions were originally scheduled ........
