Background Facts Plaintiffs, Harold Daily, by and through his successor-in-interest, Rosalyn Daily, as well as Rosalyn, Miyashi, Harold, Jamall, and Rejean Daily, in their individual capacities, filed this action against Defendant, Intercommunity Care Centers, Inc. dba Intercommunity Care Center for elder abuse and wrongful death. Plaintiffs allege Decedent spent three months in Defendant’s care prior to his death, which was caused by Defendant’s neglect, including failure to care for a pressure ulcer. Motions to Compel Further Responses At issue today are Defendant’s motions to compel further responses to special interrogatories and requests for production of documents. The Court finds the parties have not sufficiently met and conferred regarding the discovery that forms the basis of these motions, and accordingly continues the hearing on the motions.
