I. Background

Plaintiffs David and Bonnie Buck (“Plaintiffs”) bring this action against Ford Motor Company (“FMC”) and Lithia Ford Lincoln of Fresno (“Lithia”), alleging lemon law claims.

According to the allegations of the complaint, in 2010, Plaintiffs purchased a vehicle from Lithia, which was manufactured and distributed by FMC. (Complaint, ¶ 8.) During the term of the express, three-year warranty, the vehicle contained or developed numerous defects. (Id. at ¶¶ 9, 10.) The defects impair the use, value, or safety of the vehicle. (Id. at ¶ 10.) FMC and Lithia have been unable to service or repair the vehicle in conformity with the express warranty, despite a reasonable number of opportunities to do so. (Id. at ¶ 11.)

Based on the foregoing, Plaintiffs allege four causes of action for: (1) violation of Civil Code section 1793.2, subdivision (d); (2) violation of Civil Code section 1793.2, subdivision (b); (3) violation of civil Code section 1793.2, subdivision (a)(3); and (4) brea
