Discussion
Plaintiff Rezvan Kadkhodazadeh (“Plaintiff”) filed the instant action for negligence and motor vehicle negligence against Defendant Vilma Martinez (“Defendant”) on November 5, 2018. Defendant filed the instant demurrer and motion to strike on December 20, 2018.
The hearing was initially set for January 24, 2019, at which time the court ordered the matter continued to allow Defendant to file a request for judicial notice and meet and confer declaration. Defendant filed the supplemental papers on March 25, 2019. The court finds that the meet and confer declaration satisfies the requirements of Code of Civil Procedure sections 430.41 and 435.5. (See Motion, Supp. Morris Decl., ¶13.) The court also grants Defendant’s request for judicial notice of the court records from Kadkhodazadeh v. Martinez, LASC
