TENTATIVE RULING:
Plaintiff Interinsurance Exchange of the Automobile Club’s Motions to Deem the Truth of Matters in Requests for Admissions as Admitted, to Compel Responses to Form Interrogatories, and for Monetary Sanctions are GRANTED.
ANALYSIS:
I. Background
On February 4, 2019, Plaintiff Interinsurance Exchange of the Automobile Club (“Plaintiff”) served Requests for Admissions and Form Interrogatories on Defendant Azure Marshay Pena (“Ms. Pena”). (Tapper Decls. ¶ 2, Exhs. As.) To date, Ms. Pena has not responded to the discovery requests. (Id. ¶ 5.) For this reason, Plaintiff brought the instant two Motions to Deem the Truth of Matters in Requests for Admissions as Admitted, to Compel Responses to Form Interrogatories, and for Monetary Sanctions (collectively, the “Motions”) on May 6, 2019.
