TENTATIVE RULING:

Plaintiff Michael Jacobsen’s Motion for An Order Compelling Verizon to Comply with a Subpoena to Produce Records is DENIED WITHOUT PREJUDICE.

Pursuant to CCP § 1985.3(b)(1), plaintiff is required to personally serve on third-party consumer Denny Benavides a copy of the subpoena for his records issued to Verizon, a copy of the proof of service of the subpoena on Verizon, and Notice to Consumer and Objection pursuant to CCP § 1985.3(c)(1). Plaintiff did not provide a proof of service indicating that such service occurred. Nor was Benavides served with this motion to compel production.
