Motion for Leave to Amend Answer

Having considered the moving, opposing, and reply papers the Court rules as follows.

BACKGROUND

On December 13, 2018, Plaintiff Shahnaz Ali (“Plaintiff”) filed a complaint against Defendants Armen Arshakyan and David Resendiz. The complaint alleges motor vehicle negligence for an incident that occurred on December 6, 2017.

On January 14, 2019, Plaintiff filed a first amended complaint.

On May 17, 2019, Defendant/Cross-Complainant David Resendiz filed a cross-complaint against Defendant/Cross-Defendant Armen Arshakyan seeking apportionment and declaratory relief.

On January 13, 2020, Defendant/Cross-Complainant David Resendiz filed a motion for leave to amend its answer pursuant to California Code of Civil procedure section 473, subdivision (a).

Trial is set for June 11, 2019.

PARTY’S REQUEST

Defendant/Cross-Complainant David Resendiz (“Moving Pary”) asks the Court for leave to file an amended answer to include the following affirmative defenses
