Plaintiff Hugo Plancarte’s Motion To Compel Deposition of Person Most Knowledgeable and Custodian of Records is DENIED. Plaintiff's request for monetary sanctions is also denied.
The Court finds that Plaintiff has failed to show that reasonable meet and confer efforts were made in a good faith attempt to resolve the issues in dispute that are raised in this motion, as required by the Court's May 14, 2020 Order and under Code of Civil Procedure section 2025.450 after admittedly receiving Defendant's objections to the notice of deposition. Further, Plaintiff also failed comply with the Court's May 14, 2020 Order requiring a Joint Report regarding the meet and confer efforts conducted and the status of this dispute, to be filed on or before June 17, 2020. Interestingly, Plaintiff's Reply Brief conveniently omits addressing this failure, even though it is argued in Defendant's Opposition Brief.
