TENTATIVE RULING
On December 18, 2018, Surrey Six Board and Training, LLC (“Plaintiff”) filed this breach of contract action against Louis Rico Tejada (“Defendant”), as a limited civil action. Plaintiff is a stallion station located in Paso Robles, California, and brought this action to recover fees due and owed for the breeding of a foal and the boarding and care of the baby and its mother. Plaintiff has been caring for and feeding the mare and foal since 2017, and its damages continue to accrue.
Plaintiff filed proof of personal service on Defendant, but Defendant has not appeared. Default was entered on February 5, 2019.
On December 18, 2019, this Court granted Plaintiff a continuance to submit its default judgment package due to challenges faced by Plaintiff and by its then-counsel, and set a default prove-up hearing for April 15, 2020. That hearing was continued due to COVID- 19 to August 3, 2020.
Counsel for Plaintiff failed appear at the hearing, and no documents had been filed
