Defendant Nationstar Mortgage LLC dba Mr. Cooper (“Nationstar” or “Defendant”) demurs to the complaint (“Complaint”) filed by plaintiffs Minha Do and Cuong Viet Do (collectively, “Plaintiffs”).

I. Factual and Procedural Background

This is an action for a variety of violations of the California Homeowner Bill of Rights (the “HBOR”), among other things, arising out of the threatened foreclosure of a property (the “Property”) that is located in Monte Sereno and owned by Plaintiffs. According to the allegations of the operative Complaint, in December 2005, Plaintiffs purchased the Property with financing obtained from America’s Wholesale Lender. (Complaint, ¶ 14.) The loan was secured by a promissory note (the “Note”) and Deed of Trust (“DOT”), the latter of which was properly recorded in the Santa Clara County Recorder’s Office. (Id. and Exhibit A.)
