I. Background
This lawsuit arises from a dispute over real property located in San Jose, California.
In 2004, Ngoc Tram Nguyen and her husband Loc T. Nguyen (collectively, “Plaintiffs”) agreed to purchase real property along with Marlene C. Nguyen and Edmund P. Nguyen (collectively, “Defendants”), Ngoc’s sister and brother-in-law. Plaintiffs and Defendants orally agreed to purchase two adjacent units, namely 1697 and 1699 Foxworthy Avenue. Although not especially clear, it appears they treated these units as one parcel (the “Property”) and agreed they would each own 50 percent of the Property.
In 2008, apparently after purchasing the Property, the parties “reduced their oral agreement to a written agreement with Defendants reflecting that Plaintiffs [purchased] 50% of the Property and Defendants [purchased] the other 50% of the Property for $670,000 with each [ ] contributing $73,370.83 as [a] down payment. . . .” (Compl., ¶ 13.)
