DEMURRER TO FIRST AMENDED COMPLAINT The demurrer is sustained, with leave to amend. Plaintiff’s action is bared by the 10-yea statute of limitations for claims of latent defects (CCP §337.15). The allegations of the Firs Amended Complaint are insufficient to establish an equitable estoppel The 10-year statute of limitations for latent defects commenced at the latest in Januar 2004. This is a “generous but firm cut-off date for latent-defects suits”. Lantzy v Centex Home (2003) 31 Cal. 4th 363, 369. Plaintiff is therefore unable to rely on the “discovery rule” to exten the 10-year limitations period., which expired, at the latest, by January 2014 While equitable estoppel may extend the 10-year limitations period under Lantzy Plaintiff has pled no facts indicating that defendants’ conduct directly prevented her from filin suit. Plaintiff’s allegations fall short of those alleged in Lantzy, in which the court found that th plaintiff had failed to allege an equitable estoppel, despite alle
