The petition re: contempt is denied as to Kim Kephart. Petitioners have not prove beyond a reasonable doubt that Kim Kephart has willfully disobeyed the Court’s 10/23/18 orde or that she has the ability to make Shane Kephart and/or Kiele Wallace comply with the order (Conn v. Superior Court (1987) 196 Cal.App.3d 774, 784 ) As to Tim Kephart, unless he can explain to the satisfaction of the Court the discrepanc between his declaration in which he said he moved out of 211 Blackburn no later than 3/15/2 (Tim Kephart Dec. filed 2/24/21 ¶2) and his Cross-complaint in which he said that he moved ou of 211 Blackburn Street on or about June 2020, (Cross-complaint filed 10/19/20 attached as Ex 1 to Hamerslough Dec. filed 3/5/21 at ¶ 22), Tim Kephart will be ordered to pay Petitione $3,000.00 rent for March-June 2020 or 4 x $3,000.00 = $12,000.00 within 30 days of the date o service of this order.
