I. Background

In this a gender discrimination and retaliation action, Plaintiff Penelope Armstrong (“Plaintiff”), a female Los Angeles County Sheriff’s deputy, alleges that she was discriminated against and harassed from June 2008 and continuing through January 2013. Plaintiff alleges that when she complained about the harassment, she was ridiculed, her complaint was discarded, and the harassment increased.

A. Procedural History

Plaintiff’s original Complaint was filed on 11/22/13. On 4/30/14, Plaintiff filed her First Amended Complaint (“FAC”), alleging causes of action for:
1. Discrimination based on sex;
2. Harassment based on sex;
3. Failure to prevent discrimination based on sex;
4. Retaliation;
5. California Labor Cod
