Motion for terminating and monetary sanctions
Defendant’s unopposed motion for monetary and terminating sanctions is GRANTED, the complaint is ordered stricken and the case dismissed, and Plaintiff is ordered to pay monetary sanctions pursuant to CCP § 2023.030(a) in the amount of $1,715.00 by January 22, 2020.
The undisputed facts establish that Plaintiff failed to comply with discovery orders issued by this court on September 20, 2019 and October 17, 2019. Since no opposition has been filed and since appropriate issue sanctions would have the same effect as a terminating sanction, the motion for terminating sanctions is GRANTED.
