Motion for Summary of Judgment
[At defendant’s request, the hearing was continued from December 19, 2019 to allow for oral argument.]
Defendant Priscilla Xiong’s unopposed motion for summary judgment or, in the alternative, summary adjudication is GRANTED. Defendant’s separate statement of undisputed facts is supported by admissible evidence that establishes a prima facie case that defendant is entitled to judgment as a matter of law. This shifts the burden of proof to plaintiff to provide admissible evidence establishing that a triable issue of material fact exists. Plaintiff has filed no opposition, no separate statement disputing any of defendant’s undisputed facts, and no evidence in opposition to the motion. Accordingly, the motion for summary judgment is GRANTED.
The Court will sign the proposed order lodged by defendant on September 25, 2019.
