This is a collections case for an unpaid debt. Before the Court this day is an unopposed motion for summary judgment. Service appears to be proper. The salient facts and issues are not complex.
On or about 07/15/15, defendant borrowed from plaintiff a loan in the amount of $75,000.00, with interest accruing at 12.9% per annum. Defendant agreed to repay the loan with an initial payment of $456.88, following by 180 monthly payments of $944.00. Defendant made good on his promise to repay, at least for the better part of two years. However, in or about October of 2017, defendant stopped making his monthly payments. He did not reach out to negotiate a loan modification, or seek any other relief. Instead, he just went silent. At present, there is still $71,944.64 due and owing on the loan. This does not include accrued interest and costs associated herewith for collection (court costs, attorney fees).
