Cross-Defendant’s demurrer to the complaint is CONTINUED TO June 11, 2018, at 8:30 a.m. in Department 94.

See Code Civ. Proc., § 430.41(a). provides, in part that before filing a demurrer, the demurring party shall meet and confer in person or by telephone with the party who filed the pleading that is subject to demurrer for the purpose of determining whether an agreement can be reached that would resolve the objections to be raised in the demurrer.

Defendants have failed to file a declaration demonstrating satisfaction of meet and confer efforts pursuant to CCP section 430.41. (See Mellon Decl. ¶¶ 1-5; Markarian Decl. ¶¶ 1-13.) Cross-Defendant’s declarations only state that the parties discussed the timing of a responsive pleading via email before the demurrer was filed, and then the propriety of the demurrer itself via email after the demurrer was filed. (Ibid.) Cross-Defendant is ordered to meet and confer with Cross-Complainant and file a declaration regarding such efforts by May
