TENTATIVE RULING
On August 6, 2017, Harvey C. Hunt and Gwendolyn M. Hunt, Trustees of the H&G Hunt Trust dated 9/27/1996 (Plaintiffs) filed this complaint against Marty and Sheila Elisarraras and Gilbert Arebalo (Plaintiffs) to foreclose on certain deeds of trust Plaintiffs recorded against real property located at 330 Old Settler Road, Paso Robles, San Luis Obispo County, California (the Property) in 2013 and 2016 (Deed of Trust-1 and Deed of Trust-2). (Compl., ¶¶ 11 & 21.)
Plaintiffs named JPMorgan Chase Bank, N.A. (Chase) as a nominal defendant because it had “acquired the beneficial interest of Washington Mutual Bank (who loaned money on the Property) by assignment recorded February 4, 2016 as Instrument No. 2016005038 of Official Records.” (Compl., ¶ 7.) Washington Mutual recorded its Equity Line of Credit Deed of Trust on June 30, 2005, and also a recorded a loan Modification Agreement with Mr. Arebalo and Mr. Elisarraras on June 7, 2007.
