Petitioner Georgia Smith’s petition to vacate the arbitration award is GRANTED.
Background
This is an action to vacate an arbitration award. Petitioner Georgia Smith alleges she was injured when her motor vehicle was struck by another motor vehicle. Petitioner alleges the nonparty who struck her vehicle was uninsured, and that she therefore filed a claim with Respondent Allstate Insurance Co., with whom she maintained uninsured motorist insurance. Respondent investigated the accident, concluded Petitioner was at fault, and denied her claim. Petitioner maintained the other driver was at fault, and moved to arbitrate the dispute, pursuant to the parties’ insurance agreement. On March 30, 2017, following a hearing on January 24, 2017, Arbitrator Alyse Golden Berkley issued an arbitration award in Respondent’s favor.
Petitioner now moves to vacate the arbitration award.
