Tentative Ruling: Plaintiff filed a Complaint against defendant on March 1, 2016 alleging negligence from a fire that occurred on June 2, 2014. A trial date was originally set for February 7, 2018. However, at the settlement conference, a new trial date was set for November 7, 2018.
On or about January 19, 2018, plaintiff originally filed a Motion to Reopen Discovery and Submit Tardy Expert Witness Information before trial. The Court denied that motion on February 23, 2018. The Court specifically stated “[p]laintiff’s Motion . . . To Reopen Discovery is Denied, Without Prejudice to be renewed expeditiously with full compliance with all statutory requirements.” (Bold lettering included in the original ruling.)
In regards to the request to submit the tardy expert witness information, the Court specifically ruled “[p]laintiff’s Motion to Submit Tardy Expert Witness Information is Denied, Without Prejudice to be renewed expeditiously with full compliance with all statutory requirements.”
