This is a slip and fall action. The facts are largely undisputed. On March 12, 1974, Parnas Company leased the subject premises at 2335 West Winchester Boulevard in Campbell to Southland Corporation. (See Pl.’s separate statement of disputed and undisputed material facts, no. (“UMF”) 1.) On July 13, 1999, amendment #1 was made whereby Russo Winchester succeeded in interest to Parnas Company as the lessor of the subject premises, and 7-Eleven, Inc. formerly known as Southland Corporation (“7-Eleven”), amended the lease to grant an additional ten years to them and two additional successive five-year options.
