Nature of Proceedings: Motion: Summary Judgment

Tentative Ruling: The court denies the motion of defendant State of California, acting by and through the California Highway Patrol, for summary judgment or, in the alternative, summary adjudication.

Background: Plaintiff Stanley Vincent originally filed this action on July 19, 2016, in the San Francisco Superior Court. It was transferred to this Court in December 2016.

In his first amended complaint, Vincent alleges that defendants The State of California, California Highway Patrol (“CHP”), and CHP Captain Mark D’Arelli terminated his 8-year employment in November, 2014, after he took an emergency medical leave of absence to locate and care for his disabled sister in Haiti—for whom he was primary caretaker and de facto parent—who was suffering an acute medical crisis and had been reported missing. The first amended complaint alleges causes of action for (1) interference in violation of the California Family Rights Act (“CFRA”), (2) re
