The motion for judgment on the pleadings is denied. The standard for the court in deciding the motion is whether the answer does not state facts sufficient to constitute a defense to the complaint. See CCP Section 438(c)(1)(A). Here, the answer raises a triable issue of fact in that alleges that the order of December 15, 2015 in case PR-40660 states that a deed of trust in the amount of $12,984.14 is to be recorded in defendant Albrecht's favor against the specific property in question (and only that property).
