Appearance Required. There was no appearance by Plaintiff at the Case Management Conference held on December 9, 2019. Since then, on a substitution of attorney has been filed whereby Counsel for Plaintiff, Kyle Hampton, Esq. was substituted out and Plaintiff Patricia Hay Correia, Trustee of the Grace E. Hay 2014 Living Trust, was substituted in pro per. As a general rule, a non-attorney trustee cannot appear pro per on behalf of trust and the beneficiaries thereof, because such action constitutes the unauthorized practice of law. (Ziegler v. Nickel (1998) 64 Cal.App.4th 545.) Plaintiff Patricia Hay Correia, Trustee of the Grace E. Hay 2014 Living Trust, is ordered to appear, explain the status of her representation, and show cause why this matter should not be dismissed.
