Plaintiff Lola Campbell (“Plaintiff”) filed the instant action for motor vehicle negligence against Defendant Lydia Warren (“Defendant”) on August 28, 2015. Trial was scheduled for February 28, 2017. When Plaintiff failed to appear on that date, the court dismissed the action without prejudice. Plaintiff now moves to set aside the February 28, 2017 dismissal pursuant to CCP section 473, subdivision (b), based on the mistake of his attorney in failing to appear.
