Tentative Ruling: On June 13, 2018, the parties reached an agreement which was recited in court. The minute order does not include any details of the agreement; however a court reporter was present. Defendant has filed a motion for entry of judgment. Plaintiff does not agree with the terms proposed by defendant.
The Court DENIES the motion without prejudice. No evidence has been presented to support defendant’s motion as to the claimed terms of the agreement.
Defendant’s motion is lacking Exhibits 2 through 7. Although a court reporter was present, neither party submitted a transcript outlining the parties’ agreement.
Defendant failed to comply with Local Rule 3.3.7 enacted January 1, 2018, by failing to include the necessary language in the notice of motion regarding the Court’s tentative ruling system which provides an additional basis to deny a motion. Failure to comply with said Local rule in any subsequent motion on this matter will provide a basis for denial.
