Tentative Ruling:
For the reasons set forth herein, the demurrer of defendant David H. Barakat to the first amended complaint is sustained with leave to amend. Plaintiff Coaster Lee Eggleston shall file and serve his second amended complaint on or before October 31, 2013.
Background:
Plaintiff Coaster Lee Eggleston, appearing here in propria persona, filed his original Judicial Council form complaint on June 17, 2013. The original complaint attached one cause of action form for “intentional tort” and substantively alleged:
